TERMS AND CONDITIONS
This site (NuclearJob.net, hereafter referred to as the “Site”) is intended for use by employers and jobseekers aged 18 years and older for purposes of providing or seeking employment in the nuclear power and nuclear energy industries. You may not use this site for other purposes. The term, “User”, as used herein, refers to any person accessing the “Site”, including jobseekers and employers.
The terms and conditions provided herein form a binding agreement between you and the owner of Nuclearjob.net, R.W. West Corporation (a Florida corporation referred to hereafter as “NuclearJob”), effective starting January 1, 2008. Your access to the Nuclearjob.net site indicates you accept all terms and conditions and use the site in accordance with applicable laws and regulations, for its intended purpose, as interpreted by NuclearJob.
NuclearJob may periodically revise services, terms and conditions with or without notice. You agree that NuclearJob will not be liable to you or any third party for consequences, results or effects of any suspension, terminations or changes to service(s).
No business relations are created by this agreement. With the exception of use of the Site, provisions of all sections of this agreement survive any termination or suspension of the agreement.
Your use of the Site signifies your consent to receive electronic communications in the forms of emails and site postings and the use of electronic communication in lieu of written communication satisfies legal requirements for written communications.
Use of the Site in other countries by foreigners or US citizens may not be possible or legal and NuclearJob assumes no responsibility or liability for use or unavailability outside the United States.
You will indemnify, defend and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees), harmless from any claim, suit or demand, including reasonable attorneys' fees, costs and damages, made by any third party due to or arising out of your use of the Site, content posted on the Site by you, breach of this Agreement, or your violation of any law or the rights of a third party.
NuclearJob reserves the right to offer third party services to Users without representation as to the quality, usefulness or nature of those services and without warranty or guarantee of those services. You agree that NuclearJob will not be liable for any loss or damage incurred as a result of your dealings with any third parties.
You agree that NuclearJob may access, store or disclose your account information and Content if required to do so by law or in accordance with requirements of a relevant legal proceeding.
2. License, Registration and User Account
Lawful Users of the site are granted a limited, non-exclusive, revocable license to view and download a single copy of material on the site for the purpose of seeking personal employment. Jobseekers wishing to post a single resume/CV and apply to jobs online may do so, upon successful completion of the registration process. The registration process requires Users to supply information and select a password, as described in the Site’s registration web pages.
In consideration of a fee, lawful Users who are employers are granted a limited, non-exclusive, revocable license to post employment openings, as delineated in and subject to conditions contained in service agreements shown in the Site’s registration web pages. Employers wishing to post employment opportunities (job listings) are required to register with the Site.
Registered Users may not share their accounts with other Users or non-Users. Registered Users are responsible for all uses of their registration and password. You agree to inform NuclearJob immediately upon discovery of any unauthorized password usage. NuclearJob will not be liable for losses, damages or claims resulting from security breaches or unauthorized use of Users’ accounts and passwords.
Registered Users shall maintain current and accurate registration information.
NuclearJob reserves the right to terminate site access for Users breaching the Site’s Terms and Conditions.
3. User Content, Postings, Submissions and Links
Unregistered Users may not post content on the Site.
Registered jobseekers may post a resume and the contact information requested on the Site’s jobseeker registration page. Jobseeker postings, including resume and contact details, may only contain factual information directly related to the jobseeker and for the sole purpose of being considered for employment in the nuclear power or nuclear energy industries. Jobseekers may not post links to other website pages or computers.
Registered employers may post employment opportunities/job openings, subject to the limitations of service agreements shown in the Site’s registration web pages. Employer content, including job postings, may only contain factual information directly related to the employer’s actual current job openings for the sole intent of employing persons in the nuclear power or nuclear energy industries. Employer content may not include inaccurate, misleading, promotional, objectionable, discriminatory, illegal or otherwise inappropriate wording, images, graphics or other material. Employer’s job postings shall: 1) describe specific job openings for employees or contracted consultant individuals and will not be used for soliciting services, materials, proposals, bids or information from other companies, businesses or organizations; 2) describe specific job openings details such as title, job description, location, duration, compensation, benefits and start date. Employer content may include not more than one link, limited to a single website page, which must be part of the employer’s own website and not be involved in employment or recruitment services for any industry, but may be the employer’s own internal job posting page or home page.
NuclearJob is not responsible for the accuracy, validity, legality, appropriateness or acceptability of linked third-party website pages and NuclearJob assumes no liability for the consequences associated with linking to or interacting with third-party website pages.
Users are fully and solely responsible for their content (including postings) and for resultant actions or lack thereof. NuclearJob is not liable for consequences resulting from the use, misuse or lack of use of any User content including incomplete, erroneous or misleading postings. NuclearJob reserves the right to remove objectionable, inappropriate, illegal or noncompliant content, however, NuclearJob assumes no obligation to screen or filter any User content.
Submissions to NuclearJob for the purpose of providing concerns or comments are welcome, however Nuclearjob will not be obliged to act on or assume any liability for not acting on any concerns or comments from Users. Any submissions shall become the sole property of Nuclearjob and may be used accordingly, without regard to the original motivation for and intent of the submission.
4. Restrictions on Use and Re-Use of Content
The Site’s content is copyrighted, protected by United States and international copyright laws and is the property of NuclearJob or its registered employers and registered jobseekers. All rights are reserved by the respective content owners. Nuclearjob makes no claim to content made available by registered Users where content meets the intent of the Site’s purpose. Users have no right to copy, sell, trade or resell any content unless specifically authorized to do so by the content owner or as allowed by the Terms and Condition. Logos, trademarks and presentation styles are also protected, with all rights reserved by content owners.
The Site’s code may not be modified, copied, sold, distributed or “reverse engineered” by any User or non-User.
Registered Users may not assign or resell their rights or obligations under the Site’s Terms and Conditions or registration service agreements.
NuclearJob may block, restrict or terminate Site access with or without notice to Users infringing on the rights of owners of protected content.
By registering and posting content, registered Users certify and warrant their ownership of rights to post the content they post.
5. Conduct of Users
Users shall limit their use of the Site to viewing and listing employment opportunities in the nuclear power and nuclear energy industries.
Users may not revise or delete content other than their own. Users may not upload viruses, spyware, adware or other malicious code. Users may not send unsolicited, inappropriate or unrelated email to registered employers or registered employees.
Users’ job applications and responses to job postings shall apply directly to the job posting and may not be used to promote, solicit or describe business opportunities, products, services, materials or any other items not related to the job described in the listing.
Users are prohibited from tampering with, redirecting or otherwise altering, tracking or recording the normal flow of network traffic to or from the Site. Users are also prohibited from making unauthorized attempts to modify network software or hardware used or store, serve or distribute Site content.
Users may not impersonate other Users or intentionally mislead employers or jobseekers as to identity, qualifications or intent.
6. Limitations on Site Usage
You (all Users) agree to use the Site in accordance with the Terms and Conditions.
NuclearJob may establish rules and limits concerning use of the Site and related services, including restrictions on size and quantity of emails, maximum allotted disk space on the Site’s server, maximum bandwidth usage.
You agree you will not use the site for any purpose other than the intended use of seeking or posting jobs in the nuclear power and nuclear energy industries.
You agree to not interefere with the proper functioning of the Site or activities conducted on the Site.
The use of NuclearJob content on another website or in a networked computer environment for any purposes is prohibited.
You agree you will not use any automated means to access the Site.
You agree you will not use the Site to obtain employment data for use in another website or other database for use in recruitment, personnel services or any other purposes.
7. DISCLAIMER OF WARRANTIES, DAMAGE LIMITATION AND LIMITS OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THIS SITE AND ITS SERVICES IS AT YOUR SOLE RISK. THIS SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE ARE PROVIDED BY NUCLEARJOB ON AN “AS IS” AND “AS AVAILABLE” BASIS. NUCLEARJOB MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE, UNLESS OTHERWISE SPECIFIED IN WRITING.
TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, NUCLEARJOB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NUCLEARJOB DOES NOT WARRANT THAT THIS SITE; INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE; THEIR SERVERS; OR E-MAIL SENT FROM NUCLEARJOB ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
